What Is Section 75 of the Consumer Credit Act 1974?

Section 75 of the Consumer Credit Act 1974 covers agreements between an individual (“a debtor”) and any other person (“the creditor”) by which the creditor supplies the debtor with credit. This covers credit cards along with a variety of loans.

What Are Your Options?

The CCA 1974 provides a remedy for customers where they have lost out financially.  It covers situations including the following:

  • where consumers have been misled by false advertising or marketing
  • where consumers failed to receive the goods they were purchasing

In these circumstances, section 75 of the CCA 1974 allows consumers to bring a claim against not only the supplier but also the creditor. For example, if a retailer is no longer trading or has since become insolvent, you can also bring a claim against the provider of the credit card used in the transaction.
